1. Pass the Electoral Count Reform Act.
· Selection of electors must occur as provided by the laws of the state enacted prior to election day.
· The role of the vice president in counting electoral votes is purely ceremonial (ministerial).
· The threshold for members of Congress to initiate objections to electoral results is raised to one-fifth of each chamber,
· Establishes a process for expedited court review of election results.
· Specifies that during the counting of electoral college votes, Congress must treat the electors certified by a state (as modified by any state or federal court relief) as conclusive.
2. Accountability
· Criminal referrals to the Department of Justice for the President and several of his closest consiglieres like John Eastman. Ethics Committee referrals for the four House members who refused to be questioned pursuant to subpoena.
· Courts and bar disciplinary bodies responsible for overseeing the legal profession in the states and the District of Columbia should continue to evaluate the conduct of attorneys described in this Report. Your law license comes with an oath to support and adhere to the Constitution and does not give you free license to overthrow the democratic election process.
· The Department of Justice should take appropriate action to prevent its attorneys from participating in campaign-related activities, or activities aimed at subverting the rule of law and overturning a lawful elections.
3. Violent extremism
· Federal Agencies with intelligence and security missions should (a) move forward on whole-of-government strategies to combat the threat of violent activity posed by all extremist groups, including white nationalist groups and violent anti-government groups while respecting the civil rights and First Amendment civil liberties of all citizens; and (b) review their intelligence sharing protocols to ensure that threat intelligence is properly prioritized and shared with other responsible agencies
4. 14th Amendment, §3; bar individuals participating in efforts to overthrow the government from holding any future office
· Congressional committees of jurisdiction should consider creating a formal mechanism for evaluating whether to bar those individuals identified in this Report (as trying to overthrow the government) from holding future federal or state or local office.
5. Designate the counting of the electoral ballots for the Presidency a National Special Security Event.
· Given what occurred in 2021, Congress and the Executive Branch should work together to designate the joint session of Congress occurring on January 6th as a National Special Security Event.
6. Increase the criminal penalties under 18 USC §1512(c)2
7. Give the House of Representatives independent civil subpoena enforcement authority in the federal courts
8. Give increased protection to election workers from threats
9. Increase oversight of the upgrading of the Capitol Police
10. Evaluate the policies of social media companies in spreading disinformation
