Well just when we thought we had seen it all in creative lawyering, Texas is now suing the four states Biden won (Michigan, Pennsylvania, Georgia and Wisconsin, I’m not sure why they left out Arizona) saying their mail in and absentee balloting procedures violated the US Constitution. They are asking the Supreme Court to intervene and order the state legislatures to decide the state’s electors rather than the state’s voters. They have combined all the craziest ideas and zaniest conspiracy theories that have been rejected by state and federal judges across the nation, and they are maintaining that the Democrats stole the election from Donald Trump and the Supreme Court has to step in before the Electoral College acts next week.

To put it gently, this is a Hail Mary with a snow ball’s chance in hell. The Supreme Court will probably decline to hear it or dismiss it for lack of standing without ever getting to the merits, of which there are none, since Biden won by over 7 million votes and 306 electoral votes. Not only was there no widespread fraud occurring, but multiple recounts in Georgia, one of the closest states, confirmed Biden’s victory there, and recounts in the most populous Wisconsin counties confirmed Biden’s victory there. One might hope the Supreme Court would put a wooden stake through the heart of these bogus claims and vexatious litigation.

Today is “safe harbor” day; that insulates a state’s certification of its election from any efforts in Congress to over-ride the voters’ will and decisions in that state; all states except Wisconsin, where there are still two pending law suits, have certified their results and met the safe harbor requirements. https://apnews.com/article/safe-harbor-law-locks-congress-joe-biden-119b6e1570f33af0baee1493cbbe012b Texas’ lawsuit seeks to set aside today’s “safe barbor" and also next Monday’s scheduled votes in the Electoral College. Basically they are asking nine Supreme Court justices to over-rule 80 million American voters pick for our next President.

PS: The Supreme Court just turned down 9-0 the efforts of some GOP leaders in Pennsylvania to invalidate all the mail ballots in the Commonwealth.
